COVID-19 travel restrictions made me overstay my visa. Will this impact my immigration status?

UPDATED as of January 1, 2021:

Per the Department of Foreign Affairs (DFA) of the Philippines:

The United States is among countries subject to Travel Restrictions and Information for Passengers Transiting Concerned Areas. This is based on the Malacañang Palace Memorandum issued on December 29, 2020 on the regulation of entry for travelers from or transiting through areas that have reported incidence of the new COVID-19 variant. First, make sure to understand the difference between the date of expiration of your visa and how long you are allowed to stay in the U.S. based on the nature of your visa.

According to the Bureau of Consular Affairs:

“The visa expiration date is shown on the visa along with the visa issuance date. The time between visa issuance and expiration date is called your visa validity. The visa validity is the length of time you are permitted to travel to a port-of-entry in the United States.”

If you overstay beyond the date that the officer of the U.S. Customs and Border Patrol (CBP) has given you at your port of entry to the United States, your visa will automatically void or cancel unless you have filed either an application for an extension of stay or a change of status.

If the COVID-19 pandemic has caused you to extend your stay in the United States due to flight cancellations and travel advisories from the COVID-19 Inter-Agency Task Force in the Philippines, it is recommended to keep a record of your original planned travel including bookings and itineraries.

It is encouraged to contact the United States Citizenship and Immigration Services (USCIS) before your visa validity expires. For more information on who is eligible to extend their stay and what the requirements are to support your application, see “How do I Extend my Stay?”
